Product Guidelines for Nyraa Services

Nyraa’s Product Guidelines (the “Guidelines”) are set forth below. Capitalized terms used herein but not defined shall have the meanings given to them in the Terms of Service and/or Merchant Terms, as applicable, and the terms and conditions of all of the foregoing are incorporated herein by reference.

 

1. Overview

You must ensure that all products and Content that you make available on the Services meet these Guidelines. We reserve the right to modify these Guidelines, in our sole discretion, at any time, so please check back periodically for changes. You acknowledge and agree to:

  • abide by these Guidelines, the Terms of Service and the Merchant Terms (if you are a Merchant), and refrain from making available any prohibited products identified under these Guidelines;
  • comply with all applicable laws, rules and regulations, including safety, labeling, testing, warning, import/export and other consumer protection law requirements;
  • not infringe upon or misappropriate the intellectual property, publicity or other rights of others;
  • not provide any false, inaccurate or misleading information about your products; and
  • ensure that you have all necessary rights, licenses, permissions and consents to offer for sale and sell the products through the Services.

We are not responsible for determining whether you meet the above requirements, and you hereby release us from any liability with respect thereto and agree to indemnify us with respect thereto as set forth in the Terms of Service. Your compliance with the foregoing requirement is a material condition of your participation as a Merchant in the Services.

 

2. Prohibited Products

You may not market, promote or sell any of the following products via the Services:

  • Any hazardous, toxic, flammable, biohazardous, radioactive, unsafe or dangerous products
  • Any products containing asbestos or flame-retardant chemicals
  • Products containing Cannabidiol (CBD) or Tetrahydrocannabinol (THC)
  • Embargoed goods
  • Products related to terrorist organizations
  • Counterfeit products or products that you do not have the right to sell (including products that are illegally imported or exported)
  • Any recalled products
  • Pornography, including images, videos or other offensive materials
  • Age restricted goods and goods with varying legal status on a state-by-state basis
  • Products that are offensive or promote, incite or glorify hate or violence towards any person or group
  • Firearms / firearm ammunition, fireworks and weapons, including knives, explosives and related items
  • Lock picking devices
  • Products containing any amount of alcohol or drugs, including prescription, legal or illegal drugs
  • Drug paraphernalia
  • Medical devices
  • Cigarettes, cigars, tobacco, electronic cigarettes, e-liquid, vape sticks or pens, hookah pipes, bongs, vaporizers and other smoking paraphernalia
  • Dietary supplements
  • Any perishable foods, including meat, fish, vegetables, fruits and dairy products
  • Animal or animal products, including fur (excluding leather goods)
  • Children’s car seats or harnesses
  • Culturally insensitive products or products that promote or celebrate unlawful violence toward any group
  • Artifacts, cultural heritage and grave-related items
  • Human remains and body parts
  • Confederate flag merchandise
  • Digital goods, including software
  • Credit cards and debit cards
  • Stocks and other securities
  • Currency, coins, cash equivalents, Bitcoin or other similar digital or virtual currency (including virtual video game currency)
  • Gift cards
  • Stamps
  • Fine art
  • Gambling or lottery related items
  • Cell phones and prepaid phone cards
  • Any other products that we determine in our discretion to be inappropriate for availability on Nyraa

 

3. Violation of these Product Guidelines

If you breach any of these Guidelines, we will have the right to remove some or all of your products from your Store, temporarily suspend or permanently terminate your account and/or the Agreement and/or your access to the Services, in our sole discretion and without prior notice to you.
